Why do you need an attorney if you have a signed contract? Can’t a title company and/or the bank complete the paperwork?

In the state of North Carolina, the law states that you need a North Carolina licensed attorney to provide closing services for real estate transactions. We represent your legal rights. We’ve represented many sellers and buyers to prepare contracts if they aren’t using a Realtor®. For those using a Realtor®, we’ve reviewed contracts prior to signing, and we act as the middleman working with you, your Realtor®, and your Lender. We make sure the property you expect to purchase or sell is the property you own or will be purchasing. We assist with payoffs of existing mortgages, look for outstanding liens or problems with title, and prepare the deeds or other closing documents to conform with state law…and we explain the process to you as we go through the process.

Realtors and lenders can expect timely, personal and friendly service. We take pride in promptly and thoroughly researching title to your property. We offer a very competitive set fee for buyers and sellers, so you know what your final expense for your closing will be. No hidden or separate charges for a title search or document preparation or closing ceremony, unless an issue is discovered that needs to be taken care of before closing and would take a lot of additional time and effort to remedy. The only typical fees we would add are fees we have to pay others – Title Insurance, wire fees or overnight mailing fees. Call our office. Mail-Away Closings
Not every buyer or seller will be in town for the closing ceremony. These are called “Mail-Away” closings, although the documents no longer need to be mailed days in advance and take several days to return. Gillette Law Firm makes mail-away closings faster, safer and more economical for clients by using secure e-mail and secure internet file sharing if you feel comfortable to receive documents in this manner. We can send your documents securely via e-mail to save time and expenses, or conventionally via overnight mail as well. You may sign them with a local Notary and return them to us by mail.
We now have the technology for video linking during closing. If you would like to close your transaction at another location, such as your Realtor’s office, your home or anywhere else you have computer access to video feed, we can provide a Notary to be present to witness your signature and we simply return the documents to our county for filing electronically or by mail or in person. There is an additional fee for this service. Call the office today if you are interested in this new service.
Gillette Law is now available for e-closings! We have E-Notaries on our staff as well as the ability to provide complete electronic closing of transactions. If your lender wishes to perform an e-closing, just let us know so we can work with them to make it a seamless and quick closing for you.
